HearAgain.co.uk is an online service and these Terms and Conditions apply to your use of this website. Please read these Terms & Conditions in conjunction with HearAgain.co.uk Privacy Policy, which forms part of these conditions.

By using this website you agree to these Terms and Conditions. If you do not wish to be bound by these Terms and Conditions you should not use this website.

HearAgain.co.uk may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the site. You acknowledge and agree that you have not relied upon any representations, statements, agreements or undertakings not set out in these Terms and Conditions. The current version of these Terms and Conditions supersede any previous version(s).

1.Definitions:

1.4 ‘Product’ or ‘service provider’ means the supplier, distributor or provider of any service or product promoted on this website or made available via this website.

1.5 ‘service’ or ‘services’ means the service of introducing you to you to a product or service provider by the HearAgain.co.uk website. 

1.6 ‘estimate’, ‘quote’ or ‘quotation’ means a price provided by a product or service provider on the basis of the information you have provided. Providing you with a quote does not guarantee the availability of the product, the service or the price provided as you will need to deal directly with the product or service provider to make a purchase.

1.7 ‘agreement’, ‘conditions’ or ‘terms’ means any condition, terms, or all conditions and agreements made in these Terms and Conditions.

2.1 This Site is aimed at UK residents and nothing within it or these Terms and Conditions constitutes an offer or promotion of services or products to persons outside the United Kingdom. The product or service provider's terms and conditions will cover any transaction or agreement between you and the product or service provider, whereas these Terms and Conditions agreed with us relate only to your use of this Site and provision of our services.

3. Our Services; What services do we provide?

3.1 HearAgain.co.uk will only provide an introduction to a relevant third-party. HearAgain.co.uk will not give any advice however, we will process your enquiry and introduce you to a relevant third-party who may advise and/or make a recommendation for you after they have assessed your needs and requirements. We accept no liability whatsoever for the terms applying to any contract entered into with any third-party product or service provider or complaints that may arise directly in connection with service received or your product purchased.

3.2 All information we supply to you will be in the English language. The law of England and Wales applies to the services we provide, and the courts of England and Wales have the non-exclusive jurisdiction to settle any disputes about our services.

8. Copyright, licenses and Site content.

13. Miscellaneous

13.1 The validity, construction and performance of these Conditions shall be governed by English law and shall be subject to the exclusive jurisdiction of the Courts of the United Kingdom.

13.2  You agree that any legal action or proceeding between HearAgain.co.uk and you for any purpose concerning this agreement and its conditions or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in the United Kingdom. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred.

13.3 You acknowledge that HearAgain.co.uk failure to insist upon or enforce strict performance of any provision of these Terms and Conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. HearAgain.co.uk may assign its rights and duties under this Agreement to any party at any time without notice to you. Any rights not expressly granted herein are reserved.

13.4  If any part, term or provision of these Conditions, not being of a fundamental nature, shall be held to be illegal or unenforceable, the validity or enforceability of the remainder of these Conditions shall not be affected.

13.5 The waiver of any breach of any provisions of these Conditions shall not be construed as a waiver of any subsequent breach of a Condition, nor shall any delay or omission on the part of either party to exercise any right under these Conditions operate as a waiver of any breach or default by the other party.

13.6 Any notice required to be served by these Conditions shall be sent by email to HearAgain.co.uk given email address, or your email address provided to HearAgain.co.uk.
